These Terms of Service (“Terms”) are an agreement between you and Tapugo FZCO (“Tapugo”, “we”, “us”), Dubai, United Arab Emirates. They apply to our mobile games, including Card Factory, and to the website tapugo.games (together, the “Services”). By installing, opening or using the Services you accept these Terms. If you do not agree, do not use the Services.
How we handle your information is described in our Privacy Policy, which forms part of these Terms.
1. Who may use the Services
You must be at least 13 years old, or older where your country sets a higher minimum age for online services. If you are under the age of majority where you live, a parent or legal guardian must agree to these Terms on your behalf and is responsible for your use, including any purchases.
2. Your licence to play
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play our games on a device you own or control, for your own entertainment, as permitted by these Terms and by the rules of the app store you downloaded the game from. We keep all rights not expressly granted.
3. Accounts and saved progress
- Our games work without registration. Progress is stored on your device and on our servers under an identifier we create for you.
- You may link your progress to Sign in with Apple to recover it on another device. You are responsible for keeping access to your Apple account secure.
- You may delete your account and all associated data at any time from the game's settings screen. Deletion is permanent and removes saved progress, virtual items and team membership; it cannot be undone, and purchases cannot be restored to a deleted account.
- We may suspend or close an account that breaches these Terms, after which section 11 applies.
4. Virtual items and currency
Our games contain virtual currency (such as coins and lives) and virtual items that you can earn by playing, receive from rewarded videos, or buy. Virtual items are a limited licence to use a feature of the game. They have no monetary value, cannot be exchanged for money or anything of value outside the game, cannot be transferred to another person or account, and may be changed, rebalanced or withdrawn when we update the game. The amounts granted for gameplay, rewarded videos and purchases are determined by our servers.
5. Purchases
- In-app purchases are made through Apple's App Store and are subject to Apple's terms and payment methods. We do not receive your payment details.
- Prices are shown in the store before you confirm a purchase and may vary by country. Consumable items (for example coin packs) are used up as you play. Non-consumable items (for example the No Ads upgrade) can be restored on your other devices through the Restore Purchases option, subject to Apple's rules.
- All purchases are final once delivered, except where the law or Apple's refund policy gives you a right to a refund. Refund requests are handled by Apple. If a purchase is refunded or reversed, we may remove the corresponding items or entitlement.
6. Advertising and rewarded videos
Our free games are funded by advertising served through our partners. Rewarded videos are optional; you decide whether to watch one in exchange for a reward described before you start. Rewards are granted only after the advertising partner confirms to our servers that the video was completed, and are subject to daily limits and other rules that we may adjust. Ads and rewards may be unavailable in some countries, on some devices or at some times, and their absence is not a defect of the game. Purchasing the No Ads upgrade removes automatic ads between levels but keeps optional rewarded videos available.
7. Fair play
You agree not to:
- cheat, use bots, scripts, modified game clients, emulators for automation, or any tool that alters gameplay, currency, rewards or purchases;
- exploit bugs or errors instead of reporting them to us;
- reverse engineer, decompile or tamper with the game or our servers, or interfere with other players' use of them;
- access our servers other than through the unmodified game, or attempt to obtain items, rewards or refunds you are not entitled to;
- use an offensive, misleading or infringing nickname, harass other players, or use social features for anything other than playing the game;
- sell, rent or trade accounts, items or currency.
We may investigate suspected breaches, remove items or progress obtained through them, and suspend or close accounts involved.
8. Social features and user content
Where a game offers teams, leaderboards or similar features, your nickname and gameplay results are visible to other players. You are responsible for anything you submit. You grant us a worldwide, royalty-free licence to display it inside the Services for as long as you use them. We may remove content or restrict features at our discretion.
9. Updates, availability and changes
We may update, change or discontinue any part of the Services, including levels, features, virtual items and support for older devices or operating system versions, at any time. Online features depend on our servers and your connection and may be interrupted for maintenance or for reasons outside our control. We will give reasonable notice before permanently shutting down a game where practicable.
10. Intellectual property
The Services, including all software, artwork, music, characters, names and logos, belong to Tapugo or its licensors and are protected by copyright, trademark and other laws. You may not use them outside the Services without our written permission, except that you may share screenshots and gameplay videos for non-commercial purposes with attribution to Tapugo.
11. Termination
You may stop using the Services at any time by uninstalling the game or deleting your account. We may terminate or suspend your access if you breach these Terms, if required by law, or if we discontinue a Service. On termination your licence ends and you lose access to virtual items and progress; sections 4, 10, 12, 13 and 15 continue to apply.
12. Disclaimer of warranties
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties, express or implied, including as to merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, error-free or secure. Nothing in these Terms limits the rights you have as a consumer under applicable law.
13. Limitation of liability
To the fullest extent permitted by law, Tapugo will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, progress, virtual items, profits or goodwill, arising out of or related to the Services. Our total liability for all claims relating to the Services is limited to the greater of the amount you paid us in the twelve months before the claim and 50 US dollars. Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.
14. Apple App Store terms
These Terms are between you and Tapugo only, not Apple. Apple has no obligation to provide maintenance or support for the game and is not responsible for addressing any claim relating to it, including product liability, legal or regulatory compliance and intellectual property claims. If the game fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
15. Governing law and disputes
These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, and the courts of Dubai have exclusive jurisdiction, except that if you are a consumer in the European Union, United Kingdom or another country whose law gives you the protection of your local courts and mandatory consumer rules, those rules and courts apply. Before starting any dispute, please contact us so we can try to resolve it informally.
16. Changes to these Terms
We may update these Terms when the Services or the law change. The date at the top shows the latest version. For material changes we will inform you in the game or on this website before they take effect; continuing to use the Services after that means you accept the new Terms.
